The Commercial Manager is a key member of the senior leadership team on a Design-Build or Major Project and responsible for negotiating and subsequently administering the Teaming Agreement, Proposal Services Agreement, and/or Final Design Services Agreement. The role aligns contract requirements, monitors risks and opportunities, and manages commercial performance including the pursuit and securing contract changes.  The Commercial Manager reports to the Project Manager and works closely with Legal and other key stakeholders.

 

Key activities and responsibilities include:

  • Driving resolution of contractual and commercial matters during teaming, RFQ and RFP negotiations.
  • Leading Contract and Commercial Management activities across all stages of the project
  • Confirming that scope definition is clear, unambiguous, and suitable for measuring contract changes.
  • Outlining the plan for final negotiations with the contractor, with the final design fee negotiated alongside the final contract terms, scope, and schedule.
  • Engaging with the Contractor’s Commercial Lead to establish detailed working processes for commercial management and maintaining a positive relationship with the Client’s Commercial team.
  • Developing commercial management dashboards and related reporting.
  • Establishing the Management Plans, including Contract and Change Management.
  • Verifying that the technical project teams maintain their Change Control Registers by conducting regular audits and facilitating coordination meetings.
  • Setting the subconsultant procurement strategy and overseeing alignment of contract terms and subcontracts.
  • Confirming that subcontractor scopes of services are clear and unambiguous, enabling accurate measurement of changes.
  • Responsible for timely invoicing and payments.
  • Providing commercial advice to the Senior Leadership Team and elevating significant issues and risks promptly.
  • Contributes to the project risk strategy, assignment of ownership for the identified risks and opportunities and provides advice on contingency levels.
  • Provides internal risk register updates for the project via regular monitoring and evaluation.
  • Responsible for delivering the risk mitigation actions assigned to the Commercial Manager as part of the risk management process.
  • Managing contractual and commercial relationships.
  • Liaising with the client, contractor, design teams, and other stakeholders to support smooth project delivery.
  • Leading the resolution of commercial disputes with the client or contractor.
  • Advising Unit and Division Leaders on commercial status and notifications required for insurance matters.

Individual pay is determined based on several factors such as work location, education, experience, and unique skills.

 

 

The expected salary for this position is $215,000 - $265,000.
